The Himachal Pradesh High Court has extended stay on the transfer of Indian Police Services Officer Ilam Afroz, as Superintendent of Police Baddi district.
Rejecting the State government’s plea to modify its earlier order, the Division Bench comprising Justice Gurmeet Singh Sandhawalia and Justice Satyan Vaidya referred the matter back to the bench that initially granted the stay order .
Advocate R.L. Chaudhary, representing the petitioner said , “ The court had previously instructed the state government to submit a panel of three IPS officers to post SP Baddi, if her transfer was necessary .”
In his plea during hearing the case in the bench on Friday during the hearing of the case Advocate General Anup Rattan argued “The transfer was part of routine administrative processes under Section 56 of the Himachal Pradesh Police Act, making it impractical to submit a specific panel for Badd, as the transfer was not a targeted action but a standard administrative procedure.”
However the court upheld its earlier decision in the case to continue the stat on the transfer of the police officer.
SP Baddi , Ilma Afoz had abruptly proceeded on long leave after reported differences with a local ruling party leader for her strict actions in certain matters, the state government had denied such reports but had posted her in the state police headquarter Shimla after her leave.
Consequently, IPS officer Ilma Afroz, currently on leave, will continue to hold her position as SP, Baddi, upon her return.
