Himachal Pradesh high Court has directed the Himachal Pradesh government to file an immediate FIR against the Director General of Police (DGP) of the state, Sanjay Kundu in a complaint filed by a Palampur based businessman Nishant Sharma.
Taking a suo- moto cognizance of the complaint by Nishant Sharma , a Division bench of the HP High Court headed by Chief Justice MS Ramchandra Rao and Justice Jyotsna Riwal Duo on Thursday , questioned the Advocate General if the state government has filed an FIR against the DGP on the basis of the complaint”?
Advocate General (AG) Anoop Rattan briefing the media persons in the matter at Shimla said “In our reply the Court was informed the allegations made by the complainant are being verified after which an FIR would be filed.”
He said, “The High Court citing a Supreme Court judgment clarified the FIR in complaints alleging threat to life, criminal intimidation and wrongful restraint of the complainant Nishant Sharma made against the DGP, has to be filed immediately and sought status report from SP Kangra and SP Shimla on Wednesday, when the matter would be taken up.”
The AG said, “A complaint by the complainant Nishant Sharma was filed on October 28 demanding registration of an FIR against the DGP to SP Shimla and SP Kangra accusing the DGP of threatening him, criminal intimidation and wrongful restraint.”
The Court has also asked SP Kangra to provide security cover to the complainant.
