Himachal Pradesh government tabled an amendment bill in Vidhan sabha on Friday to allow non-agriculturists to complete construction / transfer under section 118 of HP Land Reforms and Tenancy Act up to five years.

Tabling the bill, Revenue Minister Mahinder Singh Thakur said, “Section 118 of HP Land Tenancy and Land Reforms Act -1972 restrict the transfer of land (including transfer by a decree of a Civil Court for recovery of arrears and land revenue) by way of sale, gift will, exchange, lease mortgage with cessation, creation of a tenancy or in other manner in favour of a non-agriculturist.”

“As per sub -section (2) of the Act the exemption on certain transfers  including the transfer of land with the prior permission of the state government;  presently the Act makes its mandatory to put the land to use within a period of two years with an extension of one year,” the minister added.

He said, “The period of two years is not sufficient, particularly in cases where land is purchased for industrial, hydro project s, tourism and housing projects etc and therefore it is proposed to amend the provisions of the Act suitably.”
